May 4, 2001 - Media Release FIVE CONSTRUCTION INDUSTRY EMPLOYERS FINED FOR BREACHES OF LONG SERVICE ACT TasBuild
Limited, the administrator responsible for the portable Long Service
Scheme covering workers in the construction industry, has successfully
taken legal action against some employers who have not complied with the
current legislation. David
Louez, Chief Executive Officer of TasBuild Limited said that action had
been taken in the Hobart Supreme Court against five employers in the
construction industry. The
employers – three from the South, one from the North and one from the
North-West -– had failed to register themselves or their workers, had
failed to provide information requested or had failed to pay
contributions for long service leave. TasBuild
Limited was successful in each application, and also obtained
significant cost orders against the employers. Mr
Louez said that the Construction
Industry (Long Service) Act 1997 provided more protection for
workers in the construction industry because it required employers to
register all workers and make regular contributions to the scheme.
The scheme also benefits employers by subsidising contributions,
which means considerable savings to the employer. Despite this benefit Mr Louez said some employers where still, either deliberately or negligently, failing to fulfil their legal obligations. Mr
Louez said the successful actions undertaken by TasBuild should serve as
a warning to all employers in the construction industry to comply with
their obligations under the legislation. “TasBuild
will continue to take action against employers who fail to comply with
their obligations to ensure a level playing field and ensure that
workers in the construction industry receive their full long service
entitlements,” he said. Mr
Louez said TasBuild was able to track employers who failed to comply
with the legislation through its own existing database as well as
information received from council building activity reports and
contributors and beneficiaries of the scheme. The
Tasmanian Construction Industry Long Service Scheme was transferred from
Government control to TasBuild on July 1, 1998. Since then TasBuild has
significantly reduced the cost of the scheme to employers as well as
significantly increasing the entitlements to workers in terms of them
being able to access a return from the scheme more quickly. TasBuild
Limited has streamlined the process for the employer and has recently
introduced a website, www.tasbuild.com.au. |

APPOINTS CLIENT SERVICES MANAGER TasBuild, a private trustee company which administers the Tasmanian Construction Industry Long Service Scheme, has appointed Gavin Spinks as its Client Services Manager. Mr
Spinks, 33, was previously the State Manager of a prominent insulation
company and his background includes experience in the banking and
tourism industries. He
will be responsible for managing the marketing and promotional functions
of TasBuild as well as maintaining regular contact with members and
beneficiaries of the scheme. The
Chairman and Chief Executive of TasBuild, David Louez, welcomed the
appointment of Mr Spinks. “Gavin’s
appointment enables us to promote the scheme more widely to ensure that
it is clearly understood by employers and beneficiaries alike,” he
said. “Members
will also have a definitive point of contact for any concerns or queries
about the scheme.” The
Tasmanian Construction Industry Long Service Scheme was transferred from
Government control to TasBuild on July 1, 1998. Since then TasBuild has
significantly reduced the cost of the scheme to employers as well as
significantly increasing the entitlements to workers in terms of being
able to access a return from the scheme more quickly. TasBuild
Limited has recently reinvested approximately $8 million back into the
industry by way of seed funding for relevant construction projects such
as the Hobart Silos, Devonport Cinema and Shopping Plaza and Glenorchy
Cinema Projects. TasBuild
is continually looking for relevant construction projects
for investment purposes. |

30 January 2001 In the TasBuild newsletter that was sent with your December 2000 return you were advised that GST would be payable on your contributions to the Construction Industry Long Service Fund and that the relevant administrative matters would be resolved shortly.
These matters have now been resolved and the new procedures, as outlined below, will take effect with your January 2001 return.
